Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Moniflux website at https://moniflux.com, our mobile applications, and related services (collectively, the "Service") provided by Moniflux ("Moniflux," "we," "us," or "our").

By creating an account, signing in, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Description of the Service

Moniflux helps you manually track subscriptions, recurring bills, and related household expenses. The Service is intended for personal organization and awareness. It is not a bank, payment processor, accounting system, or financial advisor.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@moniflux.com if you suspect unauthorized access.

You agree to provide accurate account information and keep it up to date. We may suspend or terminate accounts that contain false or misleading information.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service, servers, or networks
• Scrape, crawl, or harvest data from the Service without our permission
• Reverse engineer or attempt to extract source code except where permitted by law
• Upload malware or content that is harmful, abusive, or infringing
• Use the Service to harass, spam, or impersonate others

We may investigate violations and take appropriate action, including suspending or terminating your account.

5. Your content

You retain ownership of the information you enter into the Service, such as subscription names, bill details, and household data ("User Content"). You grant Moniflux a limited license to host, store, process, and display User Content solely to operate and improve the Service as you direct.

You are responsible for User Content you submit and represent that you have the right to provide it. Do not submit sensitive information that the Service is not designed to protect beyond our standard security measures.

6. Household sharing

If you invite others to a household, you control what shared data they can access through the Service features. You are responsible for invitations you send and for ensuring that shared access is appropriate. Moniflux is not responsible for disputes between household members regarding shared data.

7. Plans, billing, and refunds

Moniflux may offer free and paid plans. Plan features and limits are described on our pricing page and may change over time. Paid features, including our lifetime plan, are processed through Stripe.

Prices are shown before purchase. By completing a purchase, you authorize us and our payment processor to charge the applicable fees. Except where required by law, all fees are non-refundable once the purchase is completed. If you believe a charge was made in error, contact us at hello@moniflux.com within 14 days of purchase.

We may change plan pricing or features for new purchases. Changes generally will not reduce paid features you have already purchased for the period or plan type described at the time of purchase, except where we are required to make changes for legal, security, or operational reasons.

8. Not financial advice

Moniflux provides organizational tools only. We do not provide financial, investment, tax, or legal advice. Amounts, due dates, and summaries in the Service depend on information you enter and may be incomplete or inaccurate. You are solely responsible for your financial decisions and for verifying any information before acting on it.

9. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Moniflux and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding except as needed to use the Service in accordance with these Terms.

10. Third-party services

The Service integrates with third-party services such as Google sign-in and Stripe payments. Your use of those services is subject to their terms and privacy policies. We are not responsible for third-party services.

11. Termination

You may stop using the Service at any time. You may request account deletion by contacting hello@moniflux.com.

We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends, but sections that by their nature should survive will continue to apply.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONIFLUX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Moniflux from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to their jurisdiction, except where applicable law requires a different forum.

16. Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If changes are material, we will provide reasonable notice, such as by email or a notice in the Service. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
